Employer questionStudents, flexi-jobs and working time

Can a student worker do a flexi-job?

No. A student worker cannot do a flexi-job on the basis of their student work: work under the solidarity contribution does not count towards the required employment of 4/5 in quarter T-3.

Can a student worker do a flexi-job? The managing director of Business Centrum at his desk in Ghent

Why a student cannot do a flexi-job

A flexi-job requires the worker to have worked at least 4/5 of a full-time job for one or more other employers in reference quarter T-3 (Article 4, § 1, of the flexi act). According to the NSSO, work as a student under the solidarity contribution, as an apprentice, as a flexi-job worker and as a young person until the end of the year in which they turn 18 does not count towards it.

Exceptions

A student who worked at least 4/5 elsewhere under an ordinary employment contract in quarter T-3, or who is a statutory pensioner, can do a flexi-job. For ordinary holiday work, the student contract remains the route.

What is the risk?

The Dimona FLX then gets a NOK answer because the employment is insufficient. If you still declare a flexi-job in the DmfA without the conditions being met, the flexi wage is increased by 125%.

What to do

Hire a student worker with a written student contract and a Dimona STU, not with a flexi contract. If in doubt, look at the Dimona answer: only OK confirms the condition.
