Taakloon (voor artiesten) is een vergoeding die in functie staat van de totale geleverde prestatie eerder dan in functie van het aantal gepresteerde arbeidsuren. Volgende criteria dienen vervuld te zijn om een werknemer uit te betalen tegen een taakloon. Indien één van de onderstaande criteria niet vervuld zijn, gelden de afgesproken lonen uit de sectorale of ondernemings-CAOen.

(1) Er is tussen de artiest en de werkgever/opdrachtgever ofwel een arbeidsovereenkomst afgesloten ofwel een overeenkomst onder artikel 1 bis van de wet van 27/06/1969 tot herziening van de besluitwet van 28/12/1944 betreffende de maatschappelijke zekerheid der arbeiders.

(2) De bovenstaande overeenkomst bepaalt expliciet dat de vergoedingswijze taakloon is.

(3) Het moet gaan om een artistieke prestatie, volgens de definitie in artikel 1 bis: "Onder "het leveren van artistieke prestaties en/of het produceren van artistieke werken" dient te worden verstaan : de creatie en/of uitvoering of interpretatie van artistieke oeuvres in de audiovisuele en de beeldende kunsten, in de muziek, de literatuur, het spektakel, het theater en de choreografie".

(4) De opdracht of taak moet duidelijk omschreven zijn in de overeenkomst.
