To get a social security payment plan in Belgium, an employer applies through the NSSO's online form, for the full debt due. The NSSO answers within 10 working days and spreads the debt over at most 24 monthly instalments. The 10% surcharge and 7% annual late-payment interest still apply, but you can ask for a waiver afterwards.

What is an amicable NSSO payment plan?

If you cannot pay your NSSO contributions on time, the NSSO can collect them through the courts or with an enforcement order. There is also an amicable route: an agreement with you, the payment plan. You pay the debt in monthly instalments of fixed amounts on fixed dates, and the NSSO refrains from enforcement as long as you comply.

The benefit is concrete. An enforcement order brings legal costs and can lead to seizure. With a plan you comply with, you keep trading normally: the NSSO takes it into account for public procurement certificates and for the decision on withholding on invoices.

The energy-crisis and COVID plans you still find online were temporary and came without sanctions. They no longer exist for new debts. What remains is the classic amicable plan.

Applying for an NSSO payment plan: step by step

  1. Map the full debt. The request must cover the total debt due on the date of the request, including older quarters and corrections. Your social secretariat or your NSSO account statement gives you the amount. Debts for which the NSSO has already started court proceedings or an enforcement order are excluded: for those, you can no longer get an amicable plan.
  2. Fill in the application form. It is on the amicable payment plans page of socialsecurity.be. You explain your reasons and indicate the monthly amount you can afford. The NSSO sets the term in consultation with you.
  3. Give concrete reasons. Explain why you cannot pay now and why that is temporary. A customer who went bankrupt, a seasonal dip, a large investment that will pay off later. Figures convince more than general explanations.
  4. Have documents ready. The NSSO may ask for supporting evidence. We routinely include a recent balance sheet or interim figures, a cash-flow forecast for the term of the plan and an overview of unpaid invoices.
  5. Wait for contact. An NSSO officer contacts you within 2 working days if there are questions. The answer follows within 10 working days.
  6. Pay the first instalment straight away. The plan starts with a first payment within 10 days of receipt, followed by equal monthly instalments.
  7. Keep paying current contributions. A plan covers the old debt. New quarters and the monthly NSSO advance payments must be paid on time. Anything you leave unpaid there falls outside the plan and triggers new surcharges and interest.

How many months can you get?

In principle, an amicable plan runs for 12 months. The NSSO can extend it to 24 monthly instalments if you show that a longer term is the only way to clear the debt while keeping the business viable. Expect a thorough review of your accounting and financial documents.

Do not ask for the maximum by default. Late-payment interest runs as long as contributions are outstanding, so a longer plan costs more. The NSSO says so itself: it is in your interest to keep the term and the number of instalments as short as possible.

What happens to NSSO surcharges and late-payment interest?

A payment plan does not exempt you from sanctions. On every contribution paid late, the NSSO charges:

SanctionAmountWhen
Contribution surcharge10% of the amount paid lateonce, as soon as the deadline passes
Late-payment interest7% per yearfrom the due date to the day of payment

These sanctions are included in the instalments of your plan. Only after full payment can you have them reduced.

Worked example

A construction company cannot pay its contributions for the second quarter of 2026, € 18,000, by the due date of 31 July 2026. The plan starts two months later.

  • Surcharge: 10% of € 18,000 = € 1,800
  • Interest before the plan starts: € 18,000 x 7% x 2/12 = € 210
  • Interest during a plan of 12 equal instalments (declining balance): about € 682.50
  • Total extra cost with 12 instalments: about € 2,692.50
  • With 24 instalments, interest during the plan rises to about € 1,312.50, and the extra cost to about € 3,322.50

The difference between 12 and 24 months is therefore about € 630 here. The NSSO calculates the exact amounts in the plan.

Waiver of NSSO surcharges: when does it work?

Once all contributions due have been paid, you can ask for the surcharges and interest to be reduced. The NSSO looks at the reason for the arrears.

SituationSurcharge reductionInterest reduction
Force majeurefullfull
Exceptional circumstancesup to 50%up to 25%
Firm claim on a public authorityup to 100%20% if you pass the money on within the month
Compelling equity or economic interestup to 100%, by decision of the Management Committeenot provided for

Force majeure is interpreted strictly: an event beyond your control, unforeseeable and insurmountable, with no fault on your part. A bad month does not qualify. For an SME, exceptional circumstances are in practice the most realistic ground, for example when a major customer defaults. The NSSO assesses each file separately.

Did you pay late but before the end of the 2nd month after the quarter, and do you normally always pay on time? Then the NSSO can waive surcharges and interest entirely. That request goes to the Payment Plans unit of the Collection department.

Payment plan and the withholding obligation

If you work in construction, the meat sector or security, NSSO debts make you subject to the withholding obligation. Your clients must then pay part of every invoice directly to the NSSO. An amicable plan you comply with keeps you clear of that. A period the NSSO grants only to suspend a seizure or enforcement does not count. More in our article on checking the withholding obligation.

Why not just wait?

Leaving NSSO debts unpaid costs more than surcharges. The Social Penal Code punishes failure to pay contributions on time with a level 3 sanction: for offences from 1 February 2026, among other options an administrative fine of € 1,000 to € 10,000, multiplied by the number of employees concerned. An application filed on time, with a realistic monthly amount, is the cheapest way out.

Social security payment plan Belgium employer: frequently asked questions

How long does the NSSO take to answer a payment plan request?

The NSSO contacts you within 2 working days if it has questions about your request. You get an answer within 10 working days. The plan then follows with fixed due dates and fixed amounts.

Do I still pay surcharges with an NSSO payment plan?

Yes. A payment plan does not exempt you from the 10% surcharge or the 7% annual late-payment interest. Both are built into the monthly instalments. Once everything is paid, you can ask for the surcharges to be waived or reduced.

What happens if I miss an instalment of my NSSO payment plan?

The amicable agreement lapses and the NSSO recovers the full debt by enforcement order, with legal costs. If you see a payment problem coming, contact the Amicable Recovery department before the due date.

Does a payment plan keep me off the withholding obligation on invoices?

An amicable payment plan you comply with is taken into account in the decision on withholding on invoices and for public procurement certificates. A period the NSSO grants only to suspend enforcement does not count.

Can I request a plan for only part of my NSSO debt?

No. The request must cover the total debt due on the date of the request. You cannot spread a single quarter and leave the rest unpaid.
