Artikel X. Concurrentiebeding.

When do you use this non-compete clause template?
When you want to stop an employee from carrying on a similar activity after leaving, self-employed or with a competitor. The clause is in writing, covers similar activities, is limited geographically to Belgium and lasts at most 12 months. If you dismiss without serious cause after the first six months, an ordinary clause does not apply.
How to fill in the non-compete clause
- 1
Check the gross annual salary: the pay at the time the contract ends is what counts.
- 2
Fill in the activity and the product group, and limit the area to places where the employee can really compete with you, never beyond Belgium.
- 3
If you do not want to apply the clause, say so in writing within 15 days of the end of the contract: you then pay no compensation.
- 4
Put the clause in the employment contract, or add it later with an annex both parties sign.
