Medical force majeure letter template: starting the procedure and ending the contract

Medical force majeure ends the contract of an employee who can permanently no longer do the work they were hired for, without notice and without compensation. The procedure can start after 6 months of uninterrupted incapacity for work. This document holds the registered notice to the employee and the letter that records the end. The templates are in Dutch and French.

Which medical force majeure letter do you use?

The first letter starts the procedure: by registered post to the employee, with a copy by registered post to the occupational doctor of your external prevention service. No reintegration process may be running at that time. You send the second letter only once the occupational doctor's finding is final: the employee had 7 calendar days to ask for adapted work and 21 calendar days to appeal.

This template contains 2 texts, each on its own page:

How to fill in the medical force majeure letters

  1. 1

Recount the period of illness on the certificates. If there were returns to work, check whether they lasted less than 14 days.

  2. 2

Keep the employee's two rights in the first letter: having adapted or other work examined, and being assisted by the union delegation. Without them, the procedure is on shaky ground.

  3. 3

In the second letter, choose the sentence that fits your case, and fill in the date of the finding and the date it was received.

  4. 4

After the end, hand over the C4, report the exit in Dimona, and report and pay € 1,800 to the Return to Work Fund within 45 calendar days.
