Garnishee declaration template for employers in Belgium

If you receive a wage garnishment as an employer, you send a garnishee declaration within 15 days. In it you state what you owe the employee: the pay, the payday, other garnishments or wage assignments. A late or incomplete declaration can make you liable for the debt and the costs of the garnishment yourself. The template is in Dutch and French.

When do you send this garnishee declaration?

After a third-party garnishment on an employee's pay has been served. From receipt of the writ you may no longer pay out the garnishable part of the pay. You send the declaration by registered post or against a receipt to the bailiff or creditor, and a copy to the employee.

How to fill in the garnishee declaration

    Fill in the bailiff's file reference and the date the garnishment was served.

    State the net pay, the payday and any other garnishment or wage assignment you have already received.

    Only mention a declaration of dependent children if the employee filed it with the official form and proof.

    Send it within 15 days by registered post or against a receipt, and give the employee a copy.

Verklaring van derde-beslagene

  2. Het nettoloon bedraagt ongeveer € [bedrag] per maand. Het loon wordt betaald op [dag] van de maand.
  3. Wij hebben op het ogenblik van het beslag [geen / de volgende] andere beslagen of loonoverdrachten ontvangen: [schuldeiser, datum, bedrag].
  4. [Indien van toepassing:] De werknemer heeft een verklaring kind ten laste ingediend voor [aantal] kinderen.
  5. Wij houden vanaf de loonbetaling van [maand] het beslagbare deel in volgens artikel 1409 van het Gerechtelijk Wetboek.

Een kopie van deze verklaring wordt aan de werknemer bezorgd.
