How the Dimona for a flexi-job worker works
Article 7/1 of the royal decree on Dimona requires the employer to declare flexi-job workers per quarter, as flexi-job workers. With an oral flexi agreement, the declaration is made per day, with the start and end time. With every Dimona FLX, the NSSO checks whether the worker meets the conditions and answers OK or NOK.
Exceptions
There is no exception. A retired flexi-job worker also needs a Dimona FLX; the NSSO then checks the pension register instead of employment with another employer.
What is the risk?
A missing or late Dimona is a level 4 offence under Article 181 of the Social Criminal Code: an administrative fine of € 3,000 to € 35,000, per employee concerned. Without a timely Dimona FLX with the answer OK, you also cannot declare the worker as a flexi-job worker in the DmfA.
What to do
File the Dimona FLX no earlier than 1 month before the start of the quarter and at the latest before the first shift, and only let the worker start after the answer OK.
